California Talcum Powder Injury Lawsuits

How Can a Talcum Powder Injury Lawyer Help Me?

Studies show that talcum powder is linked to Ovarian cancer and has long been linked with potential risks associated with long-term talc use since 1971.

Researchers discovered that talc particles were found on 75% of ovarian tumors and that there is a 33% increased risk for women who regularly used talcum powder products for feminine hygiene for developing ovarian cancer.

Various medical studies and tests suggested talc particles enter through the vaginal opening, move into the cervix and uterus, and continue through to the fallopian tubes until they reached the ovaries.

Ovarian cancer is rarely diagnosed in its early stages because it mimics many of the symptoms associated with menstrual cycles and other gynecological problems. Typically, Ovarian cancer symptoms are identified after cancer has metastasized (spread to other areas of the body).

Women who have developed Ovarian cancer often experience a loss of fertility because their ovaries must be removed.

Ovarian Cancer is a deadly disease that claims the lives of more than 14,000 women each year in the U. S.

Despite the overwhelming medical research, manufacturers failed to adequately warn consumers of the link between long-term use of talcum powder on genital areas and the elevated risk of developing Ovarian cancer. Thousands of life-long talc users may have been diagnosed with Ovarian cancer without being aware of the connection.

There are more than 1,200 lawsuits pending in state and federal courts by women who claim that they developed Ovarian cancer after using Johnson & Johnson’s Talc-containing baby powder and other talcum powder products.

What is Talcum Powder?

Talcum powder (talc) is an ingredient added in baby powders, cosmetics, deodorants, feminine hygiene products, contraceptives (condoms and diaphragms), anti-chafing products, and many talc-containing products.

Talc is a mineral that occurs naturally in our environment. It is composed primarily of magnesium, silicon, and oxygen. As a powder, talc reduces friction and absorbs moisture and is used to prevent rashes and keep skin dry. Talcum powder is ground-up talc.

Talc and Asbestos

In its basic form, talc powder can contain asbestos. Asbestos fibers that when inhaled or digested have been proven to cause Mesothelioma cancer that develops in the linings of the lungs, abdomen, or heart.

Since the 1970s, talcum powder products that people use in their homes has been asbestos-free. However, before asbestos was banned in 1980 from most consumer products containing talc, it is possible that asbestos was present in certain products like baby powder. The latency period from initial asbestos exposure to developing an asbestos cancer can be 10-50 years.

Cancer Causing Ingredients Found in Talcum Powder

Medical research has shown that talc particles can become trapped in the ovaries, causing serious inflammation, which contributes to the growth of ovarian cancer cells.

BRCA1 and BRCA2 are genes linked to ovarian cancer risk, a patient who has a BRCA1/2 mutation is known as a BRCA1/2 carrier.

The research reported in the Cancer Prevention Research Journal showed that when using a talc-based powder on or near the genitals will increase a woman's risk of developing ovarian cancer by 41%.

Symptoms Associated With Ovarian Cancer

Using talcum powder on the female genital area creates a pathway where talc particles travel through the reproductive system and attach to the ovaries. If tiny talc particles embed in the reproductive tissue, it can cause inflammation in the ovaries and fallopian tubes. Over time, the damage caused by talcum powder can lead to DNA damage of ovarian tissue and cells and cause cancer cells to multiply.

Common Symptoms Associated with Ovarian Cancer Include:

  • Abdominal Bloating
  • Abdominal Pain
  • Abdominal Pressure
  • Changes in Bowel Habits
  • Constipation
  • Difficulty Eating
  • Fatigue
  • Frequent Need to Urinate
  • Gastrointestinal Issues
  • Heartburn
  • indigestion
  • Menstrual Irregularities
  • Pelvic Discomfort
  • Unexplained Weight Gain / Weight Loss
  • Vaginal Bleeding

If you are experiencing any of these symptoms and have long-term exposure to using talc products, you should see a doctor and be checked for ovarian cancer and get proper treatment immediately.

Who Can File a Talcum Powder Lawsuit?

Since 1999, the American Cancer Society has maintained that using talc-containing products can lead to developing cancer and serious illness. If you developed cancer after using a talcum powder product, you might have the right to seek compensation.

What Happens During a Talcum Powder Injury Lawsuit?

Because each talcum powder personal injury lawsuit case is unique, it could take several months or even years to settle a claim or complete a trial. A personal lawsuit involves the following steps;

Claim Assessment - When a claim is filed, an assessment is made to ensure you have a valid case. This involves examining injury/accident details, evidence, damages suffered, medical expenses, cost of future care and the negligence of the other party. This assessment is done during your free consultation.

Investigation - If you have a qualified case, a thorough investigation of your personal injury case will begin immediately to preserve evidence. Negligent parties will also be notified, and a demand will be issued for preservation of all evidence, including photographs, equipment, and any other data.

File and Complaint - Once your evidence is preserved, a lawsuit will be filed against all parties who are deemed negligent in the accident.

Case Discovery - This is where case information is requested from the other parties, conduct depositions, interview witnesses and obtain expert analyses, accident reconstruction, and medical evidence to build a solid case.

Begin Mediation - Victims and defendants will attend mediation to determine if a fair settlement can be reached. During mediation, a negotiator will attempt to make a settlement to compensate for pain, suffering and other damages.

Go to Trial - If no settlement can be reached in mediation, the lawsuit will proceed to trial. The case will be heard by a jury or judge.  Attorney's will present evidence and participate in closing arguments. The majority of personal injury lawsuits will settle before going to trial.

Settlement - The judge or jury will then determine fault and make a decision on the amount of compensation to award for your losses.
